Notice of the Higher People's Court of Shanghai Municipality on Using the Credit Information Disclosure System for Enterprises Nationwide for Confirmation of an Enterprise's Registration Information
No. 1 and No. 2 Intermediate People's Courts; Maritime Court; Intermediate Railway Transport Court; and the courts of all districts and counties, and all railway transport courts:
The amended Company Law of the People's Republic of China officially came into force on March 1, 2014. To support the registration system reform under the Company Law, the State Administration for Industry and Commerce launched the Credit Information Disclosure System for Enterprises Nationwide (http://gsxt.saic.gov.cn) on March 1, 2014 so as to allow the public to consult information on enterprises across the country for free. In order to fully utilize the disclosure system, and facilitate and promote trial procedures, you are hereby notified of the relevant matters as follows:
I. Where a party obtains an enterprise's industrial and commercial registration information by consulting the Credit Information Disclosure System for Enterprises Nationwide, the party may present the information to the court as the basis for the enterprise's litigation eligibility status.
II. Where the opposing party objects to the above information, or the court has any doubt upon review, the court shall organize the parties to verify the information through online inquiry during trial, and admit the information upon verification that it is correct.
III. Where conditions are not available for verifying the information through online inquiry on the spot, the court may request the party presenting such information to provide the enterprise's industrial and commercial registration information which was obtained thereby from consulting the administrative department for industry and commerce.
IV. Where the opposing party fails to appear in court and participate in court proceedings, the enterprise's industrial and commercial registration information which is verified through online inquiry during trial may be admitted.
If you encounter any situation or problem during the implementation of this Notice, please report it to the Case Filing Division or Civil Division II of the Higher People's Court of Shanghai Municipality in a timely manner.
