China enforced its obligations under international law by boosting legislation

The Sixth Session of the 13th Standing Committee of the National People's Congress adopted the International Criminal Justice Assistance Law of the People's Republic of China recently with 171 votes in favour and 1 abstention. Shanghai Nuo Di Law Firm believes the move is needed to improve China's criminal legal system, strengthen international cooperation and combat serious organized crimes, including corruption crimes, and comply with the rules of international cooperation.

 

According to Shanghai Nuo Di Law Firm, the current laws related to international cooperation in the criminal category mainly include three parts: The first part, Extradition; The second part, Criminal Justice Assistance; The third part, transferring the condemned person. In the year of 2000, the Extradition Law of the People's Republic of China has been issued. "This time, the latter two parts are combined into one law."

 

The United Nations has adopted the UN Convention Against Transnational Organized Crime (UNTOC) and the UN Convention against Corruption (UNCAC), according to the Shanghai Nuo Di Law Firm. According to the latest statistics, under these two conventions, China, as a contracting party, can carry out cooperation with more than 180 countries and international organizations in the world, including criminal justice assistance. "All these international conventions that have ratified and concluded require domestic law to fulfil the obligations of international law provided for in the treaty, which is the point of making this law."
