Announcement of the Higher People's Court of Beijing Municipality on the Performance of Duties by the Beijing Intellectual Property Court
In accordance with the official replay of the State Commission Office for Public Sector Reform, the Beijing Intellectual Property Court has been set up. The relevant matters are hereby announced as follows:
I. The Beijing Intellectual Property Court shall begin to perform its statutory duties from November 6, 2014.
II. The Beijing Intellectual Property Court shall have centralized jurisdiction over civil and administrative cases regarding intellectual property rights that are originally under the jurisdiction of all intermediate people's courts of Beijing Municipality in accordance with the Decision of the Standing Committee of the National People's Congress on Establishing Intellectual Property Right Courts in Beijing, Shanghai, and Guangzhou and the Provisions of the Supreme People's Court on the Jurisdiction of Cases of Intellectual Property Right Courts of Beijing, Shanghai, and Guangzhou.
III. From November 6, 2014, all intermediate people's courts of Beijing Municipality shall no longer accept civil and administrative cases regarding intellectual property rights. Before November 5, 2014, where a party has filed a civil or administrative lawsuit regarding intellectual property rights in or appealed to the intermediate people's court and the intermediate people's court has placed the case on file but the case has not been closed, the intermediate people's court shall continue to try or review the case; and if a party has filed complaint or appeal materials but a civil or administrative case regarding intellectual property rights has not been placed on file, the intermediate people's court shall continue to examine, place the case on file, and try or review the case.
