People's Court on Issuing the Measures of the Supreme People's Court for
Organization of Pledging Allegiance to the Constitution
(No. 9 [2016] of the Supreme People's Court)
All entities of the Supreme People's Court:
The Measures of the Supreme People's Court for Organization of Pledging
Allegiance to the Constitution, as discussed
and adopted at the 16th meeting of Party group of the Supreme People's Court in
2016, are hereby issued to you for your compliance and implementation.

The Measures of the Supreme People's Court for Organization of Pledging
Allegiance to the Constitution
Article 1 For purposes of raising awareness of the Constitution, as well as inspiring and
educating people's courts' functionaries in being loyal to, abiding by and
upholding the Constitution, these
Measures are formulated under the Decision of the
Standing Committee of the National People's Congress on Implementing the System
of Pledging Allegiance to the Constitution.
Article 2 Vice Presidents, members of the Judicial Committee, division chief
judges, associate chief judges, and judges of the Supreme People's Court, and
the President of the Military Court, shall pledge allegiance to the Constitution after they are elected under
the statutory procedure.
Other state functionaries of the Supreme People's Court shall pledge allegiance
to the Constitution when taking
office.
Article 3 The pledge to the Constitution
is as follows:
I swear that I will be allegiant to the Constitution of
the People's Republic of China, safeguard the Constitution's authority, perform statutory
duties, be loyal to the country and people, be committed and honest when
performing duties, accept people's supervision, and work hard to develop China
into a socialist country that is prosperous, strong, democratic, civilized and
harmonious.
Article 4 The place where the pledge is taken shall be solemn and dignified,
and be hung with the national flag or national emblem of the People's Republic
of China.
The pledge leader and pledge taker at the ceremony of pledging allegiance to
the Constitution shall be in unified robes of
judges, other uniforms, or formal wear.
Article 5 An pledge-taking ceremony may be conducted in the form of individual
pledge or collective pledge.
Where the Vice Presidents, members of the Judicial Committee, division chief
judges, associate chief judges, and judges of the Supreme People's Court, and
the President of the Military Court take collective pledge, the President of
the Supreme People's Court, or a senior judge entrusted by him or her, shall
lead the pledge.
Where other state functionaries of the Supreme People's Court take collective
pledge, the President of the Supreme People's Court, or a person entrusted by
him or her, shall lead the pledge.
Where judges receive rank promotion, or non-leadership position promotion, a
collective pledge may be organized as required.
The pledge-taking ceremony may be supervised by the President of the Supreme
People's Court, or a person entrusted by him or her.
Article 6 The national anthem of the People's Republic of China shall be played
(sung) when the pledge-taking ceremony is held.
In the case of an individual pledge, the pledge taker shall stand facing the
national flag or national emblem, put his or her left hand on the Constitution of the People's Republic of China,
raise his or her right hand formed into a fist with its bottom facing forward,
and read aloud the pledge.
In the case of a collective pledge, the pledge leader shall stand facing the
national flag or national emblem, put his or her left hand on the Constitution of the People's Republic of China,
raise his or her right hand formed into a fist with its bottom facing forward,
and lead the reading aloud of the pledge; and the pledge takers shall stand
neatly behind the pledge leader, stand facing the national flag or national
emblem, raise their right hands formed into fists with bottoms facing forward,
and follow the pledge leader in reading aloud the pledge, and shall, after
reading the pledge, say aloud their names when the pledge leader reads aloud
"pledge taker…."
Article 7 The pledging of allegiance to the Constitution
shall be taken publicly; and deputies to the people congresses, members of the
Chinese People's Political Consultative Conference, and representatives of
relevant sectors shall be invited to participate in the pledge-taking ceremony.
Article 8 Where an event of reviewing pledge is organized for the purpose of
any important activities, these Measures shall apply.
Article 9 These Measures shall come into force on the date of issuance, and the
Notice of the Supreme People's Court on Issuing the Provisions of the People's
Republic of China on Swearing in of Judges (for Trial Implementation) shall be
concurrently repealed.
