Cross-strait Nuclear Safety Cooperation Agreement
(October 20, 2011)
“Safety first” is the universal principle that should be followed in all nuclear situations, as nuclear safety concerns the health, safety, property and environment of human beings. To ensure the well-being of people across the Taiwan Straits, improve the nuclear safety on both sides, strengthen the disclosure of nuclear safety information, and enhance nuclear safety information and experience exchange across the Taiwan Straits, upon equal negotiations, the Association for Relations across the Taiwan Straits (ARATS) and the Staits Exchange Foundation (SEF) reached a cross-strait nuclear safety cooperation agreement as follows:
I. Scope of cooperation
Both sides agree, on the principles of equality and reciprocity, to cooperate with each other regarding matters related to nuclear safety and accident reporting across the straits in the following areas:
1. Nuclear safety laws, regulations and standards
Both sides agree to exchange information on nuclear safety laws, regulations, standards, norms and references.
2. Nuclear safety analysis, examination and assessment experience
Both sides agree to exchange information and experience on approaches, procedures, reports and references for nuclear safety analysis, examination and assessment as well as the development of instruments used for nuclear safety analysis, examination and assessment.
3. Nuclear safety supervision methods and experience
Both sides agree to exchange information and experience on the operating methods, reports and references related to the nuclear safety supervision framework.
4. Basic information on nuclear power plants
Both sides agree to regularly exchange basic information on the operation of nuclear power units, worker's radiation dosage, environmental radiation monitoring, safety indicators, abnormal events and building progress of nuclear power units.
5. Experience and feedback on safety assessment and operation of nuclear events
Both sides agree to regularly exchange investigation reports, improvement measures and follow-up safety supervision reports on abnormal events on the scale of the International Nuclear Events Scale at all important nuclear power units , and exchange their experience thereabout.
6. Ageing management of nuclear power plants
Both sides agree to exchange information and experience on the ageing management, evaluation, supervision and on-site investigation of nuclear power plants.
7. Nuclear safety research experience
Both sides agree to exchange information and experience on nuclear safety research development regarding fuel safety, heat transfer and flow, digital control, fire safety, human factors engineering, risk assessment, earthquake and seaquake prevention, accident analysis and evaluation, and non-destructive quality testing or certification.
8. Urgent reporting of accidents in nuclear power plants
In the event that any side has an accident at or above scale II of the International Nuclear Events Scale or attracts public attention, that side shall notify the other side when reporting the accident to the relevant departments, maintain contact with the other side, ensure that the other side receives integrated and updated information on the accident, and immediately give response and assistance when the other side makes inquires about the accident. Entities and persons designated by both sides for liaison issues and accident reporting shall provide reporting tests in normal times.
Information reported on a nuclear power plant accident shall include the name of the nuclear power plant, the time of and possible cause for the occurrence of this accident, updated information on the nuclear power unit, the leakage of the radioactive substances, possible future effects, assessment materials, and protective measures taken. If necessary, both sides may decide what other report information is required upon negotiations.
The side which an accident occurs shall actively provide assistance to confirm the safety of the people on the other side at areas affected by the accident, and offer necessary assistance.
9. Information on the environmental radiation monitoring over nuclear power plants
Both sides agree to exchange information on environmental radiation monitoring and information on the radioactivity analysis and comparison of environmental samples which meet the generally accepted standards.
10. Experience on emergency response to and preparation for nuclear power plant accidents
Both sides agree to exchange their experience on emergency response to nuclear power plant accidents including emergency response plans, preparations in normal times, prevention actions involving the general public, and restoration plans.
11. Experience on the disclosure of nuclear safety information
Both sides agree to exchange their experience on the disclosure of nuclear safety information, including information transparency, public involvement, science popularization and actual practices.
12. Other nuclear safety matters both sides agree to cooperate on.
II. Cooperation Ways
Both sides agree that their nuclear safety and emergency response departments exchange and cooperate with each other regarding nuclear safety matters in the following ways:
1. Both sides shall hold at least one meeting to exchange work information every year in turn.
2. Both sides shall urge the relevant persons to participate in and hold seminars and other exchange activities.
3. When any major event or urgent accident occurs to a nuclear power plant, both sides shall report, exchange, consult and disclose information.
4. Other ways as both sides agree upon to enhance nuclear safety.
III. Liaison Bodies
Communications on matters agreed to in this Agreement shall be handled by and between persons designated by the nuclear safety and emergency response departments of both sides.
Communications regarding other matters relating to this Agreement shall be handled by ARATS and SEF.
IV. Work Plans
Both sides agree to form a working team to decide detailed work plans upon negotiations.
The working team shall hold an opening meeting within two months after this Agreement becomes effective to deliberate on liaison issues, windows for reporting accidents, information exchange, and reporting items, content, formats, methods and frequency, to exchange information on work, and to hold other exchange activities.
V. Use Limitation
Both sides agree to use documents provided by the other side for purposes mentioned in the request, unless it is otherwise stipulated by both sides.
VI. Document Formats
Both sides agree to use document formats determined by them upon negotiations for the purpose of exchanging information, making inquiries and making official contacts.
VII. Fulfillment of and Modification to this Agreement
Both sides shall abide by this Agreement.
Any modification to this Agreement shall be made upon the consent of both sides and confirmed by both sides in written form.
VIII. Dispute Settlement
For any dispute arising from the application of this Agreement, both sides shall resolve it through negotiations as soon as possible. Unless it is otherwise stipulated, negotiations shall be made within 10 workdays after a request is made.
IX. Other Issues
Issues not stipulated in this Agreement shall be resolved separately by both sides in an appropriate manner.
X. Effectiveness
Upon signiture of this Agreement, both sides shall complete the relevant procedures and notify each other in writing. This Agreement shall come into force from the day both sides receive the notice from the other party. .
This Agreement was signed on October 20 in quadruplicate with each party holding two.
