Notice of the Economy, Trade and Information Commission of Shenzhen Municipality on the Relevant Materials to Be Submitted by Foreign-funded Enterprises and the Requirements for the Establishment or Modification of Administrative Licensing Items

All relevant entities and individuals:
In order to improve the quality of handling the establishment or modification of administrative licensing items for foreign-funded enterprises in Shenzhen Municipality and regulate the standards for preparing administrative licensing case files, in accordance with the Notice of the Staffing Office for Public Sector Reform Commission of Shenzhen Municipality and the Legislative Affairs Office of Shenzhen Municipality on Regulating the Standards for Preparing Administrative Licensing Case Files in Shenzhen Municipality (Letter No. 507 [2016], Legislative Affairs Office of Shenzhen Municipality), you are hereby notified of the materials to be submitted by foreign-funded enterprises in Shenzhen Municipality and the requirements for the establishment or modification of administrative licensing items as follows:
I. Where an application for establishment or modification of an administrative licensing item for a foreign-funded enterprise is filed by an attorney (handling person), a power of attorney (see Annex for sample) and the identity certificates of both parties (in the case of an enterprise, the photocopy of the business opening certificate or the business license; and in the case of an individual, the photocopy of the identity card, passport, or any other valid identity certificate) shall be submitted.
Where an individual investor or the legal representative of an enterprise files an application, the identity certificate of the investor or the legal representative (photocopy of the identity card, passport, or any other valid identity certificate) shall be submitted.
II. Where in the process of handling, the attorney (handling person) or legal representative is replaced, the relevant certificate on replacement shall be submitted. The relevant acknowledgement of receipt and acknowledgement of delivery shall be signed by authorized signatories such as the individual investor and the legal representative or attorney (handling person) of the enterprise.
III. Non-original materials submitted by a foreign-funded enterprise for the establishment or modification of an administrative licensing item, such as copies, photocopies, and faxed copies shall be signed by the investor or confirmed by the seal of the foreign-funded enterprise, stating the consistency between the non-original materials and the original ones as well as the date of submission.
IV. Handwritten documents shall be written in carbon (blue or black) ink; where a handwritten document is not written in carbon (blue or black) ink, the copy shall be submitted at the same time.
V. Any change in application materials shall be confirmed with the signature (or fingerprint) of the party.
The aforesaid provisions shall come into force on the date of issuance of this Notice. All competent departments of foreign investment at the district level may, mutatis mutandis, implement this Notice.
