Several Opinions of the Administration for Industry and Commerce of Zhejiang Province on Supporting the Construction of China (Zhejiang) Pilot Free Trade Zone

Market Supervision Administration of Zhoushan City:
For purposes of implementing the spirit of the Notice of the State Council on Issuing the Framework Plan for China (Zhejiang) Pilot Free Trade Zone (No. 16 [2017], State Council) and the relevant decisions and deployment of the provincial party committee and the provincial government, fully maximizing the functional role of industrial and commercial administration, and fully supporting the construction and development of China (Zhejiang) Pilot Free Trade Zone (“ZJFTZ”), ,the following supporting opinions are hereby offered.
I. Delegating the power of enterprise registration and administration to lower levels. The market supervision department of ZJFTZ shall be allowed to exercise the registration management power of the following companies in ZJFTZ: first, a company in which the state-owned assets supervision and administration institution of the provincial people's government, or another department or institution authorized by the provincial government performs the functions of a capital contributor and any company which is invested in and formed by such a company as a shareholder holding more than 50% of the shares thereof; second, a company that is invested in by a natural person, and that is a limited liability company with a registered capital of more than 0.2 billion yuan (including the figure, here and below) or a company limited by shares established with a registered capital of more than 0.1 billion yuan; and third, a wholly owned or holding company invested in and formed by a provincial public institution legal person, social organization, or unincorporated enterprise legal person.
II. Relaxing restrictions on enterprise name registration. Enterprises in ZJFTZ shall be allowed to be named after “China (Zhejiang) Pilot Free Trade Zone,” “ZJFTZ” and other signs and use the industrial statements reflecting the functions and features of ZJFTZ in the enterprise names. The Market Supervision Administration of Zhoushan City shall be allowed to exercise the power of pre-approval for the aforesaid enterprise names. Zhoushan shall be supported in promoting the reform on the enterprise name registration system in ZJFTZ, so as to simplify the procedures for the pre-approval of names, and implement the independent declaration and registration system for enterprise names.
III. Promoting the declaration commitment system for enterprises' domiciles (business premises). ZJFTZ shall be supported in promoting the declaration commitment system for enterprises' domiciles (business premises) within the scope of ZJFTZ on the basis of implementing the domicile registration and declaration commitment system in the micro and small enterprises park, startup park and other parks on a trial basis, under the requirements of tracable sources, checkable information and controllable risks. After submitting a “Domicile (Business Premise) Information Declaration Form” and making commitment for the authenticity of the information declared, an applicant may be exempted from submitting the leasing agreement and other proof document on the land use right.
IV. Accelerating the advancement of electronic business licenses. On the basis of supporting ZJFTZ in advancing the implementation of whole-process electronic registration of “online declaration, online acceptance, online verification, identity authentication, electronic signature, electronic filing,” etc., “medium-free” electronic business license shall be promoted in an accelerated manner.
V. Supporting the market participants in ZJFTZ so that they become bigger and stronger. Markets in ZJFTZ shall be supported in being named after Zhejiang Province, the efforts of cultivating the provincial key markets and the key markets in the provincial areas shall be intensified, and priority shall be given to the special capital arrangement for the commodity trading market and the recognition of the provincial key markets. Priority shall be given to the identification of the provincial famous trademarks and the demonstration assessment of the provincial trademark brand series by the market supervision department in ZJFTZ.
VI. Comprehensively opening data resources and supporting ZJFTZ in innovating on regulatory service mode. The advantages of the strategic cooperation of the 12315 E-commerce Complaints and Rights Protection Center and the Network Goods Quality Monitoring Center of the State Administration for Industry and Commerce, the National Internet Advertisement Monitoring Center, the Corporate Credit Information Publicity System and the Administration for Industry and Commerce of Zhejiang Province and the Alibaba Platform shall be maximized, and the collection, application, exchange and sharing of the monitoring information involving the Zhoushan Islands New Area shall be realized, to provide data and technical support for innovating on the regulatory service mode in ZJFTZ.
VII. Supporting and strengthening the infrastructure construction. Through arranging special funds and by other means, the market supervision department of ZJFTZ shall be supported in strengthening the fundamental construction in grass roots, improving the enforcement equipment and accelerating the standardized and normalized construction of the grass-roots stations.
VIII. Actively seeking granting of power to administer foreign investment registration from the State Administration for Industry and Commerce. ZJFTZ shall be continuously assisted in applying to the State Administration for Industry and Commerce for granting the power to administer foreign investment registration and being responsible for the registration and supervision administration of the foreign-funded enterprises in ZJFTZ that are established with the approval of relevant departments and have undergone the formalities of recordation.
This Document shall come into force on the date of issuance.
