Announcement of the Guangzhou Customs District on Innovating the Enterprise Management System within Nansha New Area in China (Guangdong) Pilot Free Trade Zone

In order to promote the building and development of Nansha New Area in China (Guangdong) Pilot Free Trade Zone (hereinafter referred to as “GDFTZ (Nansha)”), accelerate the transformation of government functions, actively explore the innovations in customs management modes, and promote trade and investment facilitation, in accordance with the provisions of the Customs Law of the People's Republic of China and the Notice of the State Council on Issuing the Framework Plan for China (Guangdong) Pilot Free Trade Zone (No. 18 [2015], State Council), the Guangzhou Customs District has innovated the enterprise management within GDFTZ (Nansha). The relevant issues are hereby announced as follows:
I. Customs declaration enterprises within GDFTZ (Nansha) shall be subject to the mode of “registration in one place and customs declaration across the country”
The restrictions on the provision of customs clearance services by customs declaration enterprises in GDFTZ (Nansha) shall be lifted, and customs declaration enterprises within GDFTZ (Nansha) are permitted to “register in one place and undergo customs declaration formalities across the country.” At the same time, the branches of customs declaration enterprises within GDFTZ (Nansha) which have undergone the recordation formalities at any custom office nationwide may provide customs declaration services at all customs offices across the country.
II. The enterprise registration reformshall be implemented in GDFTZ (Nansha)
1. The registration administrative licensing for customs declaration enterprises in GDFTZ (Nansha) shall be cancelled.
In GDFTZ (Nansha), registration administrative licensing for customs declaration enterprises shall be cancelled, and registration recordation shall be provided for customs declaration enterprises.
The customs declaration enterprises shall satisfy the conditions as listed in Article 8 of the Provisions of the Customs of the People's Republic of China on the Administration of Registration of Customs Declaration Entities(Order No. 221, GACC). An enterprise in GDFTZ (Nansha) shall, when undergoing the formalities for the registration recordation of a customs declaration enterprise, submit the following recordation materials to the Nansha customs office:
(1) A Registration Form of the Customs Declaration Entity.
(2) A photocopy of the duplicate of its Business License for an Enterprise as a Legal Person and a photocopy of the duplicate of its organization code certificate (or a photocopy of the duplicate of its Business License for an Enterprise as a Legal Person which bears one or more license numbers.
(3) A photocopy of its certificate on the right to own or use the business premises where customs declaration services are to be provided.
An applicant that submits photocopies according to the aforesaid provisions shall simultaneously submit the original copies to the Customs for examination. Where the conditions for registration recordation of customs declaration enterprises in GDFTZ (Nansha) are satisfied, the Customs shall verify and issue the Registration Certificate of the Customs of the People's Republic of China for Customs Declaration Entities within three working days.
The registration recordation of a customs declaration enterprise in GDFTZ (Nansha) shall be valid for two years. An enterprise which needs to extend the validity of registration recordation shall undergo the certificate replacement formalities at the Nansha customs office with the registration recordation materials within 30 working days prior to the expiration of the validity period.
Where the enterprise name, legal representative, enterprise nature, domicile and other recordation information of a customs declaration enterprise in GDFTZ (Nansha) are changed, the enterprise shall, within 30 working days from the date when the change takes effect, undergo the change formalities at the Nansha customs office with the Registration Form of the Customs Declaration Entity, the duplicate of its Business License changed or other approval documents and photocopies.
A customs declaration enterprise in GDFTZ (Nansha) shall submit the Annual Report of Registration Information on the Customs Declaration Entity to the Nansha customs office prior to June 30 of each year.
2. Registration administrative licensing for double identity enterprises in GDFTZ (Nansha) shall be cancelled.
In GDFTZ (Nansha), registration administrative licensing for double identity enterprises shall be cancelled, and registration recordation shall be implemented for double identity enterprises.
Enterprises in GDFTZ (Nansha) may apply for registration recordation to become double identity enterprises in areas under special customs supervision. Double identity enterprises in GDFTZ (Nansha) shall have both the identity of consignees or consignors of imported or exported goods and the identity of customs declaration enterprises in areas under special customs supervision, but only have the identity of customs declaration enterprises outside areas under special customs supervision.
The formalities for recordation, certificate replacement, change and requirements for administration of annual report for customs declaration enterprises in GDFTZ (Nansha) shall apply to the double identity enterprises in GDFTZ (Nansha).
III. “Handling of routine tax affairs at any tax authority in the same city” and “online application” shall be achieved for the registration of enterprises in GDFTZ (Nansha).
Enterprises in GDFTZ (Nansha) may, as needed, freely choose to handle the enterprise registration business at the customs business window of the Government Affairs Service Center in Guangzhou City or the Government Affairs Service Center in Nansha Area. Of which, foreign-invested enterprises may apply for the issuance of certificates that they have not registered with the customs, the change of registration of consignees or consignors of imported or exported goods, the registration of consignees or consignors of imported or exported goods, and the recordation of employees of customs declaration enterprises at the Online Service Hall. IV. The general coordinator management mode shall be implemented in GDFTZ (Nansha).
The GSP (Generalized System of Preference) coordinator management system shall be established in GDFTZ (Nansha) to arrange highly qualified customs business coordinators for enterprises in GDFTZ (Nansha), and provide such personal services as policy publicity, rapid solution of difficult problems, evaluation on compliance with the laws and regulations, and the guidance to the application of facilitation measures. Where an enterprise in GDFTZ (Nansha) applies for being an accredited enterprise, the relevant customs coordinator shall be arranged to provide onsite guidance.
