The General Office of the CPC Central Committee and the General Office of the State Council Issuing the Opinions on Promoting the Sound and Orderly Development of the Mobile Internet
(January 2017)
With the dramatic development of information and network technology and the pervasive popularization of mobile intelligent terminals, the mobile internet has vigorously prompted the in-depth integration of the Internet and the real economy by virtue of its outstanding advantages such as ubiquity, accessibility, intelligence and universal benefit, and has become a new field of innovative development, a new platform of public services, and a new channel of information sharing. The following opinions are hereby offered for the purposes of carrying out in depth the thoughts of General Secretary Xi Jinping on the national cyber development strategy, and promoting the sound and orderly development of China's mobile internet.
I. Significance and overall requirement
(1) Importance and urgency. Since the 18th National Congress of the Communist Party of China ("CPC"), the CPC Central Committee with comrade Xi Jinping as the core has attached great importance to cybersecurity and informatization, established the Central Leading Group for Cyberspace Affairs, made a series of major decisions and arrangements, forcefully promoted the sound development of the cyberspace undertaking, especially the mobile internet, and played an important role in facilitating the work and life of the people, promoting social and economic development, and maintaining national security. Currently, with the close combination of the internet technology, platforms, application software, business models and mobile telecommunications technology, new mobile web technology is rapidly evolving, new application software is springing up, new business types are prosperously developing, the properties of tools, media and social contact are becoming increasingly outstanding, the ecological system which has preliminarily formed is expanding at an accelerating pace, and the mobile internet is increasingly becoming the new space for people to study, work and live. Nevertheless, the threat and risks to the security of the mobile internet are becoming more and more prominent, and are infiltrating economy, politics, culture, society, ecology and other fields. In the face of the new situation and challenges, there is some shortness in the development and administration of the mobile internet: The systems and mechanisms need improving, the legal construction still seems laggard, policy support is insufficient, the ability of indigenous innovation is inadequate, core technology needs urgent breakthroughs, the management foundation is relatively weak, the primary responsibility of enterprises are ineffectively implemented, and the security tactics are incomplete, among others. Those problems have restricted the sound and orderly development of the mobile internet, great importance must be attached, and resolution must not be delayed.
(2) Guiding thought. We shall comprehensively implement the spirit of the 18th CPC National Congress and the Third, Fourth, Fifth and Sixth Plenary Sessions of the 18th CPC Central Committee, be guided by the Deng Xiaoping Theory, the important thoughts of "Three Represents," and the Scientific Outlook on Development, carry out in depth the spirit of a series of important speeches, and new ideas, thoughts and strategies of ruling the state and dealing with politics of the General Secretary Xi Jinping, closely center on and advance in an overall manner the overall layout for "economic, political, cultural, social, and ecological progress," propel in an coordinated manner the Four-Pronged Comprehensive Strategy, vigorously practice new development concept, adhere to the development thought with the people as the core, equally adhere to both encouragement and support and regulated development, policy guidance and lawful administration, and economic and social benefit, reach a consensus, prevent risks, win over the people, ensure security, promote development, encourage and support technical innovation, spark and protect enterprise vigor, constantly reinforce inherent development momentum, prompt in an all-around manner the sound and orderly development of the mobile internet, better serve the big development picture of the party and the country, and enable the achievement in the development of the mobile internet to better benefit the people.
(3) Basic principles. We shall adhere to development for the people, give full play to the advantages of the mobile internet, narrow the digital gap, stimulate economic vitality, and provide the people with accessible, affordable and positive mobile internet information services; adhere to the guidance of reform, improve market access, regulate competition order, optimize the development environment, and thoroughly release innovation vigor and market energy; adhere to innovation as a priority, strengthen the orientation of objective, problem and effect, give play to the roles of managers, operators and users, and comprehensively advance the innovation on ideas, mechanisms and means, among other; adhere to content orientation, innovate on content creation, expand sharing channels, and purify the interactive ecology; adhere to classification guidance and subject the mobile internet information services to classification management; and adhere to security and controllability, comprehensively screen, scientifically assess, effectively prevent and resolve the hidden risks inflicted by the dramatic development of the mobile internet, so as to effectively ensure the security of network data, technology and application, among others.
II. Promoting the innovative development of the mobile internet
(4) Improving the market access system. The simplification of administrative procedures, delegation of powers to lower levels, combination of decentralization and control, and service optimization shall be advanced in depth, relevant administrative approval matters shall be further canceled and delegated, the implementation of the shift from "government permits before business licenses" to "business licenses before government permits" shall be accelerated, approval process shall be simplified, and approval efficiency shall be improved. A market access system matching the evolution and development of the mobile internet shall be established and improved, and the graded and classified management system of telecommunications business, and the filing management, comprehensive assessment and other systems of new mobile internet business shall be improved. On the premise of ensuring security, the development of the diversified investment and financing market shall be guided, the opening of the telecommunications market shall be vigorously, steadily and properly advanced, and the formation of a new market pattern in which various capital elements and market participants complement each other's advantages, compete with each other and jointly develop shall be promoted.
(5) Accelerating the evolution and upgrade of information infrastructure. The in-depth coverage of urban areas, gradual coverage of rural areas and prior coverage of poverty-stricken regions by fourth generation wireless communication networks shall be comprehensively advanced. The research and development of the fifth generation wireless communication technology shall be accelerated, and the standard development, system verification and commercial deployment shall be advanced in an overall manner. The capability of network services shall be improved, the structure of telecommunications charges shall be simplified, the reasonable decrease in network charges shall be realized, and the cost performance and users' experience of services shall be bettered. The investment and operating modes shall be innovated on, the popularization scope of the broadband network access shall be expanded, the establishment and application of wireless local area networks at airliners, high-speed railway, urban transport and other public space shall be accelerated, and commercial service venues shall be guided in realizing coverage by and free access to wireless local area network. The establishment of content delivery networks, cloud computing, big data platforms and other new types of application infrastructure shall be accelerated, and the layout thereof shall be optimized. The entry of private capital into the competitive business of the basic telecommunications field shall be allowed, the development of mobile telecommunications resale business shall be advanced in depth, and a market pattern with joint construction and sharing of infrastructure, and mutual competition in business and services shall be developed. The quality of the interconnection between the backbone networks of the internet shall be improved, interconnection architecture shall be optimized, and a permanent inter-network settlement mechanism based on long-running increment cost shall be explored and established, so as to better satisfy the need of users for changing an operator while using an existing number and create a good market competition environment.
(6) Making systematic breakthroughs in core technology. The implementation of the innovation-driven development strategy shall be unswervingly adhered to, resources shall be concentrated to do big things in respect of the investment in scientific research, breakthroughs in and the transformation of the achievements in mobile chips, mobile operating systems, intelligent sensors, location-based services and other core technology shall be accelerated, the development of a series of standards for essential software and hardware, development environment, and external devices, among others, shall be promoted, artificial intelligence, virtual reality, augmented reality, microelectromechanical systems, and other emerging key mobile internet technology shall be distributed without delay, and breakthroughs shall be first made in the world in some cutting-edge and disruptive technology as soon as possible. The policy of additional tax deductions for enterprise research and development shall be implemented, the core technology research and development investment mechanism shall be innovated on, a market-oriented research contest of key and core technology shall be explored, attention shall be paid to improving contribution and power of speach of China's backbone enterprises and scientific research institutions to or in the open source communities of global core technology, and the establishment of China's open source community of core technology shall be vigorously promoted.
(7) Promoting the coordinated innovation in the industry ecological system. Overall arrangements shall be made for the basic research of the mobile internet, technology innovation, industrial development and application deployment, and the coordination and interaction of all parts of the value chain shall be strengthened. Enterprises shall be encouraged and supported in becoming entities of research, development, innovation and industries, the establishment of a league consisting of enterprises, universities, research institutes and users shall be accelerated, and the upstream and downstream integration and innovation of information service enterprises, telecommunications enterprises, terminal manufacturers, device manufacturers, and basic hardware and software enterprises, among others, shall be promoted. The integrated development of information technology, digital creation and other strategic emerging industries shall be promoted. The added value of products and services shall be increased, and the moving of the mobile internet to the high end of the value chain shall be accelerated. The public service system covering the parts such as standard development, achievement transformation, testing and verification, and industrialized investment and financing assessment shall be improved. The distribution of the next generation of internet technical standards, industrial ecology and security guarantee system shall be accelerated, and evolution and upgrade to the Internet Protocol version 6 ("IPv6") shall be made comprehensively. The strategic planning on the Internet of Things, special science and technology projects and industrial development shall be advanced in an overall manner, and a group of typical demonstration projects of the application of the Internet of Things with outstanding effect, strong inspiration and high relation shall be established.
(8) Strengthening the use and protection of intellectual property rights. The patent navigation in the field of the mobile internet shall be conducted, a list of suggestions on the direction of patent distribution shall be developed, enterprises shall be encouraged to strategically distribute intellectual property rights in strategic, cutting-edge, inter-disciplinary and integration fields, and the core technology patent reserves shall be fulfilled. The establishment of intellectual property right operation, trading and service platforms shall be advanced, the advancement of the opening and sharing of patent information resources shall be accelerated, large-scale mobile internet enterprises shall be encouraged to jointly establish a patent pool, and a resource sharing and interest distribution mechanism shall be developed. The intellectual property right risk management system shall be established, and early warning of intellectual property rights and legal support for cross-border disputes shall be enhanced. The protection of the intellectual property rights such as achievements in innovation on mobile internet technology and business models, among others, shall be strengthened, the improvement of the laws and regulations shall be improved, the network service order shall be regulated, and the price of infringements and cost of violations of the law shall be raised, so as to effectively deter infringements.
III. Enhancing the driving and steering role of the mobile Internet
(9) Stimulating the vitality of the information economy. The development and improvement of the policies and measures for the growth of the information economy shall be accelerated, the development of the mobile internet shall be incorporated into the national information economy demonstration areas for overall advancement, the pilot programs of leading mobile internet technology and innovative application software shall be encouraged, innovation and entrepreneurship based on mobile internet technology shall be supported, and the transformation, upgrade, and quality and effectiveness improvement of the economy shall be promoted. The implementation of the "Internet plus" action plan and the national big data strategy shall be accelerated, the in-depth integrated development of the mobile internet and agriculture, industry and services shall be vigorously promoted, the information flow shall be used to stimulate the flow of technology, funds, talents and logistics, and the optimization of resource allocation and the rising of total factor productivity shall be promoted. The mode of the development of the information economy shall be innovated on, the effective supply of safe, high-quality mobile internet products, services and content shall be increased, new business types of the sharing economy such as car hailing, house renting and payment, among others, based on the mobile internet shall be vigorously fostered, regulated and guided, and the rapid growth of the size of information consumption, and a sound and active information consumption market shall be promoted,
(10) Supporting the development of micro, small and medium-sized internet enterprises. Relevant policies and measures issued by the state shall be made full use of to promote the innovative development of micro, small and medium-sized internet enterprises in the mobile internet field, and mass entrepreneurship and innovation shall be supported and prompted. Further play shall be given to the guiding and supporting role of the National Small and Medium Enterprise Development Fund, the national innovation fund, and the policy funds, tax and fee reduction and exemption policies shall be effectively implemented, more vigorous support in the aspects of credit guarantee, IPO, and government procurement of services, among others, shall be provided, and institutional restrictions hindering and affecting mass entrepreneurship and innovation by virtue of the mobile internet shall be eliminated. Various micro, small and medium-sized enterprises shall be vigorously supported in developing new technology, application software and business of the mobile internet, a collaborative innovation platform of the mobile internet and new types of incubators shall be established, crowd innovation, crowdsourcing, crowd support, crowdfunding and other new modes shall be developed, and financing channels of domestic private capital and venture capital shall be expanded. Full play shall be given to the leading and motivating role of basic telecommunications enterprises and large-scale internet enterprises, and the development of downstream and upstream micro, small and medium-sized enterprises shall be vigorously supported by work cooperation, open platforms, resource sharing and other means. Enterprises shall be prevented from abusing dominant market position to disrupt competition order, and a fair and orderly market competition environment shall be created.
(11) Promoting information services in benefiting all the people. The development of the e-government shall be enhanced by depending on the mobile internet, the top design of the state e-government shall be improved, and the advancement of the "Internet plus government services" shall be accelerated. On the premise of guaranteeing data security and personal privacy, the opening and use of public information resources shall be promoted, and the opening of government data sets in the service field guaranteeing people's life shall be advanced in priority. The implementation of the project of information benefiting people shall be accelerated, an integrated online service platform shall be built, the construction of a new type of smart cities shall be advanced by grades and classes, the in-depth integration of the mobile internet and public services shall be promoted, public convenience services based on the mobile internet, such as transport, travel, education, medical care, employment, social security, elderly support, public security and justice, shall be prompted in priority, the extension to streets, communities and rural areas, among others, shall be accelerated by relying on the advantages of the mobile internet such as broad coverage and precision positioning, so as to promote equal access to basic public services. Party and government departments at all levels shall be promoted in vigorously availing themselves of mobile new media to publish government information, and improve public information disclosure, public services and social governance.
(12) Implementing the network poverty alleviation action plan. According to the requirement of precision poverty alleviation, more investment shall be made in the construction of mobile internet infrastructure in central and western China and poverty-stricken rural areas, full play shall be given to the guiding role of central fiscal funds, local fiscal funds and private capital shall be motivated to make investment, and the advancement of the coverage of poverty-stricken regions by the networks shall be accelerated. Basic telecommunications enterprises shall be encouraged to provide preferential bundles in poverty-stricken regions, "user, phone, card and number" bundle business shall be explored and conducted, and poverty-stricken households shall have precision access to reduction of and exemption from charges for networks and telecommunications. With long-distance medical services, and online education and training as priorities, new technology and application software of the mobile internet shall be vigorously promoted in providing more high-quality and convenient services for the sale of farm produce, rural tourism, work guidance, employment services and skill training, among others, in poverty-stricken regions. Relying on the forces of all parties including public-welfare network poverty alleviation leagues, network and information enterprises shall be promoted in pairing up with poverty-stricken regions for support and assistance, acclaimed e-commerce platforms shall be organized to open poverty alleviation channels for poverty-stricken regions, and mobile internet application software matching the characteristics and need of the ethnic and remote regions shall be vigorously developed. Economic and social benefit shall be equally adhered to, on the basis of in-depth project discussion, full play shall be given to the role of the China Internet Investment Fund, and the sustainable implementation of education, medical care, public cultural services and other project guaranteeing people's life based on the mobile internet shall be vigorously promoted.
(13) Enriching and developing cyberculture. The dissemination pattern of the mobile internet shall be grasped, the core socialist values, online dissemination of excellent Chinese culture, and other content construction projects shall be implemented, and positive, sound, progressive and good cyberculture shall be fostered. The mobile applications of major local and central news entities, key news portals, and other mainstream media outlets shall be better developed and promoted, and various positive-energy accounts and applications shall be vigorously supported. The development of mobile applications of news media shall be enhanced, and an efficient all-media dissemination system with correct orientation and cooperation shall be established. The pilot program of special management shares in internet news information services, network publication services, dissemination of video and audio services over information networks, and other fields shall be conducted. The in-depth integrated development of traditional media and new mobile media shall be vigorously promoted, the distribution of the establishment of the mobile internet fronts shall be accelerated, and a group of media groups of new type with powerful strength, dissemination ability, credibility and influence shall be set up.
IV. Preventing security risks of the mobile internet
(14) Improving cybersecurity guarantee. Correct cybersecurity outlook and dynamic and comprehensive protection idea shall be firmly developed, the mutual promotion of security and development shall be adhered to, the trends in the security of the mobile internet shall be sensed in an all-around and round-the-clock manner, the cybersecurity guarantee ability of the basic information of the mobile internet shall be constantly enhanced, and the application of cybersecurity technology and standards of independent intellectual property rights shall be vigorously promoted. Cybersecurity and defense ability shall be enhanced, the cybersecurity responsibility system shall be implemented, the standards for the security of key information infrastructure, security of big data and other cybersecurity shall be developed and improved, and the protected subjects, and protection level and measures shall be specified. Cybersecurity inspection shall be comprehensively strengthened, truth, risks and loopholes shall be discovered, rectification shall be supervised, and a unified and efficient cybersecurity risk report mechanism, intelligence sharing mechanism and research and disposition mechanism shall be established.
(15) Protecting the lawful rights and interests of users. The mobile internet user information protection system shall be improved, the collection and use of user identity, geographic location, contact information, telecommunications content, consumption records, and other personal information shall be strictly regulated, and users' right to know and choose and of privacy shall be ensured. Mobile internet enterprises shall be supervised to effectively perform the user service agreements and fulfill the relevant commitments, improve the service quality management system and the commitment handling mechanism, and provide securer, more high-quality, convenient and practical products and services. The crackdown upon the infringements upon the rights and interests of users by making use of "fake base stations," illegal internetsites, and malicious software, among others, shall be intensified, and the rights and interests of consumers and the industrial order shall be effectively protected.
(16) Cracking down upon network violations of the law and crimes. The agitation for the subversion of the state power, incitement to religious extremism, advocation of ethnic secession thoughts, instigation of violence and terror, and other violations of the law and criminal activities by making use of the mobile internet shall be firmly cracked down. Rumor mongering, defamation, telecommunications network fraud, attack and information stealing, piracy and infringements, illegal sale of personal information, and other violations of the law and criminal activities shall be strictly investigated and handled. Illegal and irregular information on gambling, pyramid scheme, illegal fund-raising, obscenity and pornography, and involvement in fire arms and explosives, among others, shall be comprehensively cleaned up.
(17) Improving the ability of network management. The management of basic network resources shall be enhanced, basic telecommunications services shall be regulated, and the primary responsibility of basic telecommunications business operators, access service providers, internet information service providers, and domain name service providers shall be implemented. Management modes shall be innovated on, and research of and response to new technology, applications and business types, and security assessment thereof shall be strengthened. Information service management shall be improved, dissemination shall be regulated, and the positive dissemination order of the mobile internet shall be maintained.
V. Deepening international exchange and cooperation in the mobile internet
(18) Expanding space for international cooperation. Centering on the national strategy of " belt and road," online international cooperation in the Silk Road shall be advanced, the interconnection of the mobile internet infrastructure shall be promoted, and cross-border mobile e-commerce shall be vigorously developed. The development of, exchange and cooperation in international standards in key technology and important fields such as the fifth generation wireless communication, next generation of the Internet, the Internet of Things, and cybersecurity shall be vigorously participated in. Mobile internet enterprises shall be supported in heading overseas, the international market shall be developed through various means, mobile internet application software, products and services shall be better promoted overseas, a cross-border value chain system shall be built and improved, and overseas development space shall be constantly expanded.
(19) Participating in the governance of the global mobile internet. Organizations, mechanisms and activities relating to the governance of the global mobile internet shall be comprehensively participated in, and various bilateral and multilateral dialogs and cooperation shall be enhanced. The development of the rules and standards in the mobile internet field shall be deeply involved and vigorously promoted. Full play shall be given to the role of the World Internet Conference, among others, and China's ideas of internet governance shall be vigorously publicized and promoted. An information sharing mechanism shall be established and improved, and the actions of international joint crackdown upon violations of the laws and criminal activities relating to the mobile internet shall be vigorously participated in.
(20) Enhancing the development of the ability of international dissemination. People-people exchange between China and foreign countries shall be deepened, various social media platforms shall be vigorously made use of, various dissemination channels shall be effectively used, and concepts, categories and narrative universal at home and abroad shall be adopted to effective tell China's stories and show China's image. International dissemination media with relatively strong influence shall be set up, multiple-language and cross-platform interactive dissemination shall be innovated on, and the international dissemination influence of the mobile internet shall be constantly improved.
IV. Strengthening organization, leadership and work guarantee
(21) Improving the administration system. Under the uniform leadership of the Central Leading Group for Cyberspace Affairs, the Cyberspace Administration of China shall further enhance the overall coordination, supervision and inspection of the administration of the mobile internet, establish and improve joint conference, routine work conference and other systems, research and handle the major matters and situation in the development and administration of the mobile internet in all regions and of all departments, supervise and guide all regions and all departments in effectively implementing the decision matters, work arrangements and relevant requirements of the leading group; and the industry and information, public security, culture, press, publication, radio, film and television, and other relevant departments and the military shall, in accordance with their respective duties, effectively assume responsibility, strengthen in accordance with the law the supervision and administration of the business relating to the mobile internet, and develop and issue policies and measures supporting and promoting the development of the technology and industries of the mobile internet. Local cyberspace administrations shall be specified to assume the responsibility for supervision, management and law enforcement of the information content of the internet, the central, provincial and municipal-level administration systems shall be improved, and more guarantee with personnel, funds and technology, among others, shall be provided.
(22) Expanding social participation. All social sectors shall be encouraged to broadly participate in the governance of the mobile internet, the establishment of social organizations of the mobile internet shall be accelerated, and the China Internet Development Foundation, the Internet Society of China, and all other parties and forces shall be supported in vigorously conducting public-welfare internet activities. Users of the mobile Internet shall be guided in using the internet in a civilized manner, and the purification of the network environment and the protection of the network order shall be vigorously participated in. The industrial credit appraisal system and the service assessment system shall be improved, and the industrial management, enterprise self-discipline and social supervision and interaction mechanism shall be improved.
(23) Advancing the development of the talent team. The establishment of a cyberspace administration talent fostering system shall be strengthened, business ability and comprehensive quality shall be constantly improved, and attention shall be paid to the fostering, selection and employment of leaders familiar with the administration of the development of the mobile internet. The launch of pilot programs shall be adhered to, a talent introduction, appraisal, turnover and incentive mechanism shall be innovated on, and excellent talents from all aspects shall be gathered in the cyberspace administration undertaking. High-end think tanks shall be established in priority to provide intelligence support for the development and administration of the mobile internet. Special policies shall be adopted to establish a human resources and remuneration system suitable to the characteristics of cyberspace administration.
(24) Intensifying legal guarantee. The progress of the legislation on networks shall be accelerated, the measures for lawful supervision shall be improved and network risks shall be resolved. The Cybersecurity Law shall be comprehensively implemented and enforced, the advancement of the making of basic laws such as the E-commerce Law shall be accelerated, the Administrative Measures for Internet Information Services, the Regulation on the Security Protection of Key Information Infrastructure, and the Regulation on Network Protection of Minors, and other administrative regulations shall be enacted or revised. Judicial and policy interpretation shall be improved, and the extended application of the laws and regulations in force to the administration of the mobile internet shall be promoted. A network data management, personal information protection and other key management systems shall be established and improved. The multiple-department law enforcement coordination mechanism of the administration of the mobile internet shall be improved, the development of the law enforcement information technology system shall be accelerated, and the ability to identify network violations of the laws and crimes, collect evidence, and jointly investigate, handling and crackdown, among others, shall be improved. Network law popularization shall be enhanced, netizens' legal awareness shall be raised, and the network quality of all the people shall be improved.
