The Ministry of Science and Technology ("MOST") and the Ministry of Finance ("MOF") have recently distributed the Administrative Measures for the National Service Platform for Sharing Scientific and Technological Resources (the "Measures"), immediately effective from the issue date.

The Measures provide that the administration of the national platform shall comply with the basic principles of reasonable layout, integration and sharing, classification and categorization, and dynamic adjustments, and efforts shall be made to strengthen the buildup of capacity, regulate the responsible subjects and facilitate the opening-up and sharing, for this purpose. Scientific and technological resources formed with the aid of fiscal funds, must be made available to and shared with the general public, unless otherwise stipulated by confidentiality requirements and special rules. Further, it is encouraged to make public and share those scientific and technological resources, the formation of which is funded by social investment, through the national platform with the public. In addition, the Measures expressly state that the said platform shall meet five fundamental conditions, including "having established the service mode in line with the characteristics of such resources and achieved satisfactory service effects". Moreover, the platform will be devoted to missions in five respects, including "constantly collecting, sorting out and safekeeping important scientific and technological resources, focusing on the needs of national strategies". Furthermore, the Measures stress the need to establish for the platform relevant systems that comply with the country's relevant rules concerning intellectual property right protection, security and confidentiality, in order to safeguard intellectual property rights and interests of scientific and technological resource providers.
