Decision of the Standing Committee of the National People's Congress on Ratifying the Convention on Protection of Children and Cooperation in Respect of Inter-country Adoption
(Adopted on April 27, 2005)
At the 15th Session of the Standing Committee of the Tenth National People's Congress, it is decided to ratify the Convention on Protection of Children and Cooperation in Respect of Inter-country Adoption, which was adopted at the 17th diplomatic general meeting of the Conference on Hague Private International Law on November 30, 2000, and it is announced that:
1.The Ministry of Civil Affairs of the People's Republic of China is the Central organ to perform the duties of the People's Republic of China under this Convention.
2.The functions of the Central organ as provided for in Articles 15 through 21 of this Convention will be exercised by the adoption organization authorized by the government of the People's Republic of China – China Adoption Center. Only when the government of an adoption country or its authorized organization has performed the functions of the relevant Central organ, the citizens of this country can adopt Chinese children whose habitual places are located within the People's Republic of China.
3.The organs of the People's Republic of China for the issuance of foreign-related adoption certifications are the civil affairs departments of the people's governments of the provinces, autonomous regions, municipalities directly under the Central Government where the permanent residence of the adopted children. The adoption register certificates issued by these organs are adoption certificates.
4.The People's Republic of China has no obligation to acknowledge the adoption made under Paragraph 2 of the Article 39 of this Convention.
