Notice of the State Administration of Foreign Experts Affairs on Issuing the Measures for the Administration of National Talent and Intelligence Introduction Demonstration Bases
(No. 199 [2017] of the State Administration of Foreign Experts Affairs)
The administrations of foreign experts affairs of all provinces, autonomous regions, municipalities directly under the Central Government and sub-provincial cities; the Bureau of Foreign Experts Affairs of Xinjiang Production and Construction Corps; and the departments in charge of intelligence introduction of the relevant ministries and commissions of the State Council:
For the purposes of conscientiously implementing the spirit of the 19th CPC National Congress, further innovating and improving the construction of the national talent and intelligence introduction base system, and boosting the introduction of foreign talents and intelligence to better serve the economic and social development of the state, the State Administration of Foreign Experts Affairs has developed the Measures for the Administration of National Talent and Intelligence Introduction Demonstration Bases, which are hereby issued to you for your conscientious implementation.

Measures for the Administration of National Talent and Intelligence Introduction Demonstration Bases
Chapter I General Provisions
Article 1 These Measures are developed for the purposes of implementing the spirit of the 19th CPC National Congress and the decisions and arrangements of the CPC Central Committee on strengthening the introduction of foreign talents and intelligence under the new situations, practicing the strategic thinking and new development concept of “assembling talents from all over the world,” improving the administration and system building of national talent and intelligence introduction demonstration bases, and better serving the economic and social development.
Article 2 For the purpose of these Measures, “national talent and intelligence introduction demonstration bases (hereinafter referred to as “intelligence introduction bases”)” means the domestic enterprises and public institutions, social organizations, various parks and other talent and intelligence introduction parties that are named by the State Administration of Foreign Experts Affairs (“SAFEA”), have made outstanding achievements and are able to play an important demonstration and leading role in introducing talents and intelligence.
Article 3 Intelligence introduction bases shall maximizethe primary role of market, and highlight the orientation of “high-level, elite, top-notch, and urgently-needed personnel” through government guidance and support, so as to make intelligence introduction bases the platform assembling high-level foreign talents, the innovation platforms for national talent and intelligence introduction policies as well as system and mechanism, and the platforms for the cultivation, transformation and promotion of major talent and intelligence introduction achievements.
Article 4 Intelligence introduction bases shall be subject to categorized administration, and be divided into four categories, namely, “strategic scientific and technological development,” “industrial technology innovation,” “social and ecological construction,” and “agriculture and rural revitalization.”
Chapter II National Talent and Intelligence Introduction Demonstration Bases (in the Category of Strategic Scientific and Technological Development)
Article 5 “National talent and intelligence introduction demonstration bases (in the category of strategic scientific and technological development)” means the entities that have made significant progress in basic and applied research and key technology research and development by introducing foreign talents and intelligence in major science and technology development fields. An applicant shall meet the follow conditions:
(1) It is legally formed within the territory of China, and has independent legal person status (excluding a wholly foreign-owned enterprise; and if it is a Chinese-foreign equity joint venture enterprise, the Chinese side shall hold 51% or more of the shares of the enterprise, here and below).
(2) It, in line with the major science and technology development planning of the state, has made major breakthroughs in terms of innovation in forward-looking basic research technologies, generic key technologies, cutting-edge and leading technologies, and modern engineering technologies and inindustry-driven development through the introduction of foreign strategic science and technology talents, leading science and technology talents and high-level innovation teams, and thus boosted the building of the innovation system and scientific and technological strengths of the state, and formed advanced experience that can be replicated and promoted in talent and intelligence introduction mechanism innovation.
(3) In principle, it employs not less than 20 high-level foreign talents each year.
Article 6 The SAFEA will give support to the construction of bases in terms of talent and intelligence introduction project funds, foreign talent and intelligence introduction channels, and green channels for key talents, among others. The full-time foreign talents employed will be given prior financial support in their salaries and wages and other aspects.
Chapter III National Talent and Intelligence Introduction Demonstration Bases (in the Category of Industrial Technology Innovation)
Article 7 “National talent and intelligence introduction demonstration bases (in the category of industrial technology innovation)” means the entities that have achieved remarkable results in technology research and development, process improvement, and management optimization and thus promote the innovative development of industries through the introduction of foreign talents and intelligence. An applicant shall meet the following conditions:
(1) It is legally formed within the territory of China, and has independent legal person status.
(2) It, in line with the requirements of the supply-side structural reform and the strategy of turning China into a strong manufacturer, has made outstanding achievements in promoting the optimization and upgrading of traditional industries, strengthening infrastructure network construction, boosting China's industries to move toward the medium-high ends of global value chains, and cultivating world-class advanced manufacturing clusters through the introduction of foreign high-level technical and management talents , and formed unique models and successful experience in talent and intelligence introduction.
(3) In principle, it employs not less than ten high-level foreign talents each year.
Article 8 The SAFEA will give support to the construction of bases in terms of talent and intelligence introduction project funds, foreign talent and intelligence introduction channels, and characteristic exchange and cooperation platforms, among others.
Chapter IV National Talent and Intelligence Introduction Demonstration Bases (in the Category of Social and Ecological Construction)
Article 9 “National talent and intelligence introduction demonstration bases (in the category of social and ecological construction)” means the entities that have achieved significant social, economic and ecological benefits through the introduction of foreign talents and intelligence in educational culture, medicine and health, ecology and environment protection, social security, financial law, modern service industries and other fields. An applicant shall meet the following conditions:
(1) It is legally formed within the territory of China, and has independent legal person status.
(2) It, in line with the planning and layout and relevant policies for state and social governance and ecological civilization construction, has achieved outstanding results in promoting the development of education and cultural undertakings, improving the social security and governance system, building a “Healthy China” and “Beautiful China,” and implementing the regional coordination and sustainable development strategies through the introduction of various urgently-needed foreign high-end talents and intelligence, and formed the advanced, applicable working modes, rules and channels for talent and intelligence introduction.
(3) In principle, it employs not less than ten high-level foreign talents each year.
Article 10 The SAFEA will give support to the construction of bases in terms of talent and intelligence introduction project funds, foreign talent and intelligence introduction channels, and characteristic exchange and cooperation platforms, among others.
Chapter V National Talent and Intelligence Introduction Demonstration Bases (in the Category of Agriculture and Rural Revitalization)
Article 11 “National talent and intelligence introduction demonstration bases (in the category of agriculture and rural revitalization”)” means the entities that have achieved outstanding results in agricultural development, rural construction, farmers' income increase, education improvement and poverty alleviation and other aspects through the introduction of foreign talents and intelligence, and obtained remarkable results in terms of demonstration and promotion. An applicant shall meet the following conditions:
(1) It is legally formed within the territory of China, and has independent legal person status.
(2) It, in line with the national agricultural and rural development planning and strategic layout for poverty alleviation, has made remarkable achievements in introducing advanced farming, forestry, livestock, and fishing varieties and breeds and planting and breeding technologies, constructing the agricultural and rural industrial system and other aspects through the introduction of urgently-needed foreign high-end agricultural talents, and has successfully conducted the demonstration and promotion of achievements in talent and intelligence introduction, and played an important role in the implementation of the strategy of rural revitalization and promoting agricultural and rural modernization and increase of farmers' income.
(3) In principle, it employs not less than ten high-level foreign talents each year.
Article 12 In addition to supporting the bases' continuous introduction of foreign agricultural talents, the SAFEA will also support the bases in effectively conducting new foreign varieties' introduction and propagation, experiment and transformation, technical training, and publicity and promotion, and other work.
Chapter VI Application and Review
Article 13 The SAFEA will issue an intelligence introduction base application notice to the departments in charge of talent and intelligence introduction (hereinafter referred to as “departments in charge of intelligence introduction”) of all departments in all regions on a regular basis each year, specifying application process, required materials and time requirements. Applicants shall, according to the requirements of the notice, submit materials to the relevant departments in charge of intelligence introduction. The departments in charge of intelligence introduction shall, in accordance with the provisions of these Measures and the requirements of the notice, review the relevant information on the applicants and the application materials, and recommend them to the SAFEA on a merit basis.
Article 14 The SAFEA will establish the Intelligence Introduction Base Review Committee which takes charge of the review of intelligence introduction bases, and the office established under the Review Committee (under the Department of Economic and Technological Experts) shall undertake the relevant specific work. The review shall adhere to the principles of fairness, impartiality and openness, and undergo the processes of formal examination, review by the Review Committee, and publication of review results, among others, to form final decisions, and the list of enterprises selected as bases shall be issued.
Article 15 The SAFEA shall, according to the talent and intelligence introduction planning, control the total quantity of intelligence introduction bases, and, in principle, name not more than 15 intelligence introduction bases of each category each year.
Article 16 The naming of an intelligence introduction base shall be valid for five years, and, if an application for the renewal of the naming is filed upon the expiration thereof, a new application shall be filed according to the application requirements in the current year.
Chapter VII Construction and Administration
Article 17 The construction and administration of intelligence introduction bases shall adhere to the principles of common construction and being responsible according to the division of work, that is, the SAFEA and the departments in charge of intelligence introduction shall, according to their respective functions, assume the functions of administering and guiding intelligence introduction bases, and the intelligence introduction bases undertake the corresponding obligations.
Article 18 The SAFEA shall mainly perform the following functions:
(1) Developing and improving the intelligence introduction base development planning and relevant policies, and conducting the macro administration of and giving policy guidance to national intelligence introduction bases.
(2) Supporting the building of intelligence introduction bases by giving financial support to talent and intelligence introduction projects, expanding talent and intelligence introduction channels, building up network platforms, establishing coordination mechanisms, organizing exchange activities, providing expert guidance, or commending and rewarding the advanced, through media publicity and coverage, or by other means.
(3) Organizing the application review,mid-term assessmentand assessment upon expiration, among others, of intelligence introduction bases.
Article 19 The departments in charge of intelligence introduction shall mainly perform the following functions:
(1) Developing the policy planning and administrative measures for intelligence introduction bases of their respective industries in their respective regions.
(2) Conducting the routine administration of intelligence introduction bases, guiding and supervising the implementation of talent and intelligence introduction projects and use of funds, and striving for the matching of funds by the financial funds at all levels.
(3) Supporting the construction of intelligence introduction bases by opening up overseas talent employment carriers, optimizing the environment for talent and intelligence introduction, setting up comprehensive service platforms, promoting science and technology industry cooperation and other means.
(4) Effectively conducting performance evaluation, results submission, and publicity and reporting, among others.
Article 20 Intelligence introduction bases shall mainly fulfill the following obligations:
(1) Abiding by the laws and regulations of the state and the provisions of policies on talent and intelligence introduction, and accepting the administration and guidance by the SAFEA and relevant departments in charge of intelligence introduction.
(2) Innovating mechanisms, expanding channels, improving conditions, effectively implementing the talent and intelligence introduction projects of the state, regulating the use of talent and intelligence introduction funds, focusing on cultivating major talent and intelligence introduction achievements, keeping enhancing the talent and intelligence introduction levels, quality and effectiveness, and strengthening intellectual property creation, application and protection.
(3) Organizing demonstration and promotion activities, playing a leading and radiating role, participating in the promotion of the coordinated development of regions and the building ofthe “Belt and Road,”and enhancing the influence at home and abroad.
(4) Submitting the annual project plans, work summary and fund use information, among others.
Article 21 The SAFEA shall conduct the dynamic administration of intelligence introduction bases, and, where any intelligence introduction bases fall under any of the following circumstances, revoke or terminate the naming thereof:
(1) Fraudulently obtaining the naming by providing false materials or other improper means, or being issued by the people's courts at various levels as severely dishonest subjects.
(2) Making false publicity, overhyping themselves, or having any other major mistake in the work in violation of the relevant laws and regulations of the state.
(3) Conducting any acts severely violating the provisions on the administration of talent and intelligence projects and funds.
(4) Being determined as unqualified in the evaluation, and failing to be qualified after making rectification.
(5) Requesting termination of the naming on their own initiative, or their supporting institutions are legally terminated, among others.
The intelligence introduction bases with their naming revoked or terminated shall not apply for naming again within five years.
Chapter VIII Supplementary Provisions
Article 22 These Measures shall come into force on the date of issuance. The Measures for the Administration of the National Demonstration and Promotion Bases for the Introduction of Foreign Intellectual Achievements and the National Demonstration Entities for the Introduction of Foreign Intelligence (No. 23 [2008], SAFEA) shall be repealed concurrently. The national demonstration and promotion bases for the introduction of foreign intellectual achievements and the national demonstration entities for the introduction of foreign intelligence shall continue to be supported and administered in accordance with the relevant policies of the original administrative measures during the period of validity thereof, and exit automatically upon the expiration thereof.
Article 23 All provincial departments in charge of intelligence introduction may, by reference to these Measures, develop the measures for the administration of local intelligence introduction bases, build local intelligence introduction bases, and advance the system building of intelligence introduction bases at the state and provincial levels.
Article 24 The power to interpret these Measures shall remain with the SAFEA.
