Notice of the General Office of the Ministry of Human Resources and Social Security on Unemployment Registration of Taiwan, Hong Kong or Macao Residents

The departments (bureaus) of human resources and social security of all provinces, autonomous regions and municipalities directly under the Central Government:
To improve the management system for the employment of Taiwan, Hong Kong or Macao residents in the Chinese mainland, you are hereby notified of the issues concerning the unemployment registration of Taiwan, Hong Kong or Macao residents as follows:
Article 63 of the Provisions on Employment Services and Employment Management provides that “An unemployed urban resident who is above the legal working age, is capable of work and needs a job may register as unemployed at a public employment service agency. A permanent urban resident without any work experience shall register at his or her place of registered permanent residence. Rural migrant workers and other local non-permanent residents who maintain stable employment at their place of usual residence for at least six consecutive months may register at their place of usual residence when they become unemployed.” By reference to the aforesaid provisions, where Taiwan, Hong Kong or Macao residents maintain stable employment at their place of usual residence for at least six consecutive months and participate in social insurance in accordance with the law, they may register as unemployed at a public employment service agency when they become unemployed, if they are willing. The specific procedures are as follows:
I. Undergoing the formalities for cancellation of the employment certificate of a Taiwan, Hong Kong or Macao resident
When his or her employment terminates, a Taiwan, Hong Kong or Macao resident shall undergo certificate cancellation formalities at the authority which issues the employment certificates of Taiwan, Hong Kong or Macao residents, and the authority shall issue to him or her an unemployment certification document.
II. Undergoing unemployment registration formalities
A Taiwan, Hong Kong or Macao resident shall, based on the unemployment certification document and proof of rescission or termination of the employment relationship with or dismissal from his or her former employer, register as unemployed at the public employment service agency at his or her place of usual residence. A Taiwan, Hong Kong or Macao resident shall, based on the unemployment registration certification issued by the public employment service agency, enjoy employment services and relevant unemployment insurance benefits. Eligibility for employment support policies shall be separately provided for.
The number of Taiwan, Hong Kong or Macao residents who have registered as unemployed shall be included in the report on registered unemployed persons in urban areas (Table No.: Statistics EP2 of the Ministry of Human Resources and Social Security) in all places. The number shall be listed in the “number of rural migrant workers and other local non-permanent residents registering as unemployed in compliance with the relevant provisions within the reporting period” below the table and separately noted as supplementary data, and shall not be included in the statistics in the table.
