Decision of the Standing Committee of the National People's Congress on the Exercising of the Marine Right Safeguarding and Law Enforcement Functions and Powers by the China Coast Guard
(Adopted at the third Session of the Standing Committee of the Thirteenth National People's Congress on June 22, 2018)
For the purpose of implementing the spirit of the 19th CPC National Congress and the Third Plenary Session of the 19th CPC Central Committee, in accordance with the decision and deployment of the Plan for Deepening the Institutional Reform of the Party and State and the Implementation Plan for the Reform on Armed Police approved by the CPC Central Committee, the coast guard teams shall be incorporated into the Chinese People's Armed Police Force for leadership and command in an overall manner, the coast guard corps of the Chinese People's Armed Police Force shall be adjusted and formed as the China Coast Guard, and the China Coast Guard shall perform the duties of marine right safeguarding and law enforcement in a unified manner. The following decisions regarding the relevant functions and powers of the China Coast Guard are here made:
I. The China Coast Guard shall perform the duties of marine right safeguarding and law enforcement, including implementing the law enforcement tasks of cracking down on illegal and criminal maritime activities, maintaining maritime security and safeguarding, exploitation and utilization of marine resources, marine ecological environment protection, marine fishery management, maritime suppression of smuggling and other respects, and direct the local maritime law enforcement work in a coordinated manner.
II. The China Coast Guard shall implement the tasks of cracking down on illegal and criminal maritime activities, and maintaining maritime security and safeguarding, among others, and exercise the corresponding law enforcement functions and powers of the public security organs prescribed in law; and implement the law enforcement tasks of exploitation and utilization of marine resources, marine ecological environment protection, marine fishery management, maritime suppression of smuggling and other respects, and exercise the corresponding law enforcement functions and powers of the relevant administrative authorities prescribed in law. The China Coast Guard, the public security organs and the relevant administrative authorities shall establish a law enforcement cooperation mechanism.
III. When the conditions are mature, the relevant departments shall offer proposals for developing and amending the relevant laws in a timely manner, and submit them for deliberation under the legal procedures.
IV. This Decision shall come into force on July 1, 2018.
