Detailed Rules of the Shanghai Entry-Exit Inspection and Quarantine Bureau for the Implementation of "Intelligent Customs Clearance" Mode
(For Trial Implementation)
Article 1 For the purposes of further promoting trade facilitation, raising the efficiency of port clearance, and regulating the mode of "intelligent customs clearance" of entry goods at the Shanghai Port, these Detailed Rules are developed according to the Announcement on Advancing Paperless Inspection and Quarantine Declaration (No. 124 [2014]) and the Specifications for the Administration of Paperless Inspection and Quarantine Declaration (for Trial Implementation) (No. 578 [2016], General Office of the General Administration of Quality Supervision, Inspection and Quarantine, hereinafter referred to as the "Specifications") issued by the General Administration of Quality Supervision, Inspection and Quarantine.
Article 2 "'Intelligent Customs clearance' mode" means a customs clearance mode whereby, in relation to low-risk entry goods at the Shanghai Port, the inspection and quarantine business system may, based on the credit standing of an enterprise and the analysis of the risks of goods, automatically complete the screening of the risks of goods, acceptance of inspection and quarantine declaration, task assignment, sending instructions, and archiving process, etc. after the enterprise has submitted the data on inspection and quarantine declaration to the inspection and quarantine department.
Article 3 An enterprise shall, when planning to adopt the intelligent customs clearance mode, be qualified for paperless inspection and quarantine declaration and voluntarily file an application with the inspection and quarantine department in the place of inspection and quarantine declaration.
When filing an application, the enterprise shall submit a sealed Application for Intelligent Customs Clearance in Inspection and Quarantine (See Annex).
Article 4 The inspection and quarantine department shall, within three working days of receiving the application for intelligent Customs clearance from an enterprise, review the application materials submitted by the enterprise and make a review decision.
Article 5 An enterprise qualified for "intelligent customs clearance" shall, at inspection and quarantine declaration, autonomously choose whether to make the current inspection and quarantine declaration according to the "intelligent customs clearance" mode. If the mode is chosen, the enterprise shall enter into "paperless" at the table cell "Special Requirements" in the data on the inspection and quarantine declaration.
Article 6 An enterprise that adopts the "intelligent customs clearance" mode to make inspection and quarantine declaration shall upload and circulate the documentation attached to the declaration by paperless means according to the requirements of the Operating Instructions of the Shanghai Inspection and Quarantine Bureau for Paperless Inspection and Quarantine Declaration (for Trial Implementation) (Letter No. 213 [2017], Shanghai Inspection and Quarantine Bureau) and other relevant provisions.
Article 7 The inspection and quarantine department shall be responsible for maintaining relevant rules under Article 11 of these Detailed Rules so that the inspection and quarantine business system automatically sends acknowledgment of "intelligent customs clearance" to enterprises after the system has selected the data on inspection and quarantine declaration meeting the conditions for intelligent customs clearance.
An enterprise may log in onto the "Paperless Inspection and Quarantine Declaration System" with the acknowledgment of "intelligent customs clearance" to directly obtain the instructions of inspection or release from the port area and print the "Inspection and Quarantine Contact Notice."
Article 8 An enterprise that receives instructions of "release" through the "Paperless Inspection and Quarantine Declaration System" may directly claim the goods from the port area or warehouse; and an enterprise that receives instructions of "inspection" is required to bring the "Inspection and Quarantine Contact Notice" and other necessary inspection documentation and contact the inspection point specified in the contact notice for inspection. The inspector shall, upon inspection, grant release at the "Inspection and Quarantine Entry and Exit Logistics Monitoring System" to an enterprise passing the inspection, and the latter may claim the goods from the port area or warehouse.
Article 9 The inspection and quarantine department in the place of inspection and quarantine declaration shall conduct supervisory inspection of the management of inspection and quarantine declaration archives of enterprises under the intelligent customs clearance mode according to the Operating Instructions of the Shanghai Inspection and Quarantine Bureau for Paperless Inspection and Quarantine Declaration (for Trial Implementation) (Letter No. 213 [2017], Shanghai Inspection and Quarantine Bureau).
Article 10 If any of the following circumstances is discovered, the mode of "intelligent customs clearance" shall be suspended towards the relevant enterprise:
(1) The enterprise conducts false declaration, such as omission and concealment, when adopting the mode of "intelligent customs clearance".
(2) The enterprise fails to be cooperative in the inspection process without justifiable reason.
(3) In supervisory inspection, the management of inspection and quarantine declaration archives of the enterprise has been discovered to be problematic for no less than two times.
Article 11 The Customs Clearance Department shall be responsible for the maintenance and administration of relevant customs clearance documentation review rules; and all branch offices and agencies, and all relevant departments of the Shanghai Entry-Exit Inspection and Quarantine Bureau shall be responsible for proposing the needs for business administration based on which the documentation review rules are developed.
Article 12 These Detailed Rules shall be subject to the interpretation of the Customs Clearance Department of the Shanghai Entry-Exit Inspection and Quarantine Bureau and come into force upon issuance.
Application for Intelligent Customs Clearance in Inspection and Quarantine
(Name of Institution):
This enterprise (name and serial number of the recordation of inspection and quarantine declaration enterprise) voluntarily applies for adopting the mode of intelligent customs clearance in inspection and quarantine declaration and solemnly undertakes to:
1. strictly observe the relevant laws, regulations and the matters of declaration/inspection and quarantine declaration to be handled by itself (by procuration) as required;
2. in the case of an inspection and quarantine declaration agent, accept the authorization of the consignee/consignor in foreign trade and handle the matters of declaration/inspection and quarantine declaration by procuration within the scope of authorization; assume legal liability for the conduct, such as unauthorized representation, representation beyond the scope and other improper representation; and practically perform corresponding statutory duties and reasonably review the authenticity of the information provided by the principal;
3. strictly submit inspection and quarantine declaration documentation and electronic data to the inspection and quarantine institution as required and ensure the authenticity, accuracy and consistency of the inspection and quarantine declaration documentation and electronic data; and
4. Developing a complete, efficient and traceable management system of inspection and quarantine declaration materials and archives; and vigorously cooperate with the inspection and quarantine institution in the consultation, verification and follow-up management of inspection and quarantine declaration materials and archives.
