Municipal People's Government on Expanding the Scope of Legal Aid Matters
(No. 36 [2016] of the Beijing Municipal People's Government)
The people's governments of all districts; all commissions, offices, and
bureaus of the Municipal People's Government; and all institutions under the
Municipal People's Government:
In order to safeguard the lawful rights and interests of citizens with economic
difficulties and promote social fairness and justice, in accordance with the
provisions of the Regulation on Legal Aid
(Order No. 385, State Council) and the Regulation of
Beijing Municipality on Legal Aid and in light of the actual
circumstances of this Municipality, you are hereby notified of issues
concerning expanding the scope of legal aid matters as follows:
In addition to matters as prescribed in paragraph 1 of Article 10 of the Regulation on Legal Aid (Order No. 385,
State Council) and Article 9
of the Regulation of Beijing Municipality on
Legal Aid, in any of the following matters where a citizen needs an
agent but fails to entrust one, and he or she meets the requirements for
applying for legal aid due to economic difficulties, the citizen may apply to
the legal aid institutions for legal aid:
I. The citizen claims rights since his or her lawful rights and interests are
infringed upon due to the conclusion, performance, modification, rescission or
termination of an employment contract.
II. The lawful rights and interests of the citizen are infringed upon due to
land requisition, demolition, and relocation and the citizen claims rights in a
civil action.
Moreover, when applying for the following matters requiring representation,
servicemen and their families that meet the conditions of economic difficulties
or are exempted from examination of the conditions of economic difficulties
shall be offered legal aid in addition to the aforesaid matters: request for
preferential treatment; marriage and family disputes of servicemen; claim for
compensation for personal injury or property loss caused by medical negligence,
traffic accident, work-related injury as well as other case regarding personal
injury; and disputes over quality of agricultural material products, land
contracting, housing land as well as insurance compensation.
